A handy guide to the fine print

Please refer to the below terms and conditions before registering for Click and Send. If you apply for and use our Click and Send service, these terms and conditions will form a contract between you and Australia Post to govern the provision of the Click and Send service.

Please read these terms and conditions carefully. If you accept the contract and proceed to order the service, a contract will apply. If you do not agree to this contract please exit the Click and Send site before placing any service order.

1. Definitions Click to expand Click to collapse

1.1 Except where a word or phrase is expressly defined in these terms and conditions, all words and phrases shall have the same meaning, if any, given to them in the Australian Postal Corporation Act 1989 ("the Act") and in the Australia Post Terms and Conditions.

1.2 In these terms and conditions, unless the context dictates otherwise:

"Agreement" means the agreement between Australia Post and a Customer for use of the Click and Send service formed when a Customer accesses the Click and Send website, registers for use, commences ordering a product through Click and Send, is presented with an electronic request to accept the Click and Send Terms and Conditions and clicks "Accept";

"Air Mail Service" means the standard international delivery service for letters and parcels not exceeding 20kg which are not time sensitive;

"Australia Post Terms and Conditions" means the terms and conditions made pursuant to section 32 (1) (b) of the Act, and available for examination at auspost.com.au;

"Charges" means the fees and charges levied by Australia Post for collection and delivery services ordered through the Click and Send Service; Courier pick up involves an additional charge which varies depending on the service level selected.

"Click and Send", "Click and Send service", and/or "Service" means the service whereby Customers access the Click and Send website, supply information, and can receive domestic and international mailing documentation online. The Click and Send service includes the acceptance of data provided by the Customer using the Click and Send website, the printing of data displaying the Customer's selected Click and Send information, the lodgement of the printed Click and Send Postal Article for mail carriage via the Delivery Method selected by the Customer, and delivery of the Postal Article consigned through Click and Send;

"Click and Send Instructions and Procedures" means all of Australia Post's information, bulletins, user guides, manuals, and other directions and instructions (however published or displayed) to Click and Send users for use of the Click and Send service;

"Click and Send website" means the website at auspost.com.au/clickandsend;

"Courier Post" means an article lodged for carriage by the courier post service in accordance with the Australia Post Terms and Conditions;

"Customer" and/or "you" means a person who enters into an agreement with Australia Post to use the Click and Send service;

"Dangerous or Prohibited Goods" means goods which are either absolutely prohibited from carriage by post, or goods which can only be carried by post subject to certain specific conditions - concerning such matters as licensing, special packaging, and declaration of contents;

"Delivery Method" means the international post or domestic post service selected by a Click and Send Customer which can be any of the delivery services as outlined in clause 5.1;

"Express Courier International" means the Australia Post Express International delivery service as described in the Australia Post Terms and Conditions as modified by the express provisions of this Agreement;

"Express Post" means the Australia Post Express Post delivery service as described in the Australia Post Terms and Conditions as modified by the express provisions of this Agreement;

"Express Post International" means the Australia Post Express Post International delivery service as described in the Australia Post Terms and Conditions as modified by the express provisions of this Agreement;

"Extra Cover" and/or "Extra Cover Service" means the Australia Post service described at Schedule 1 of the Australia Post Terms and Conditions under which Australia Post, for a prescribed fee, agrees to compensate a Customer if a postal article covered by Extra Cover is lost or damaged in transit (see auspost.com.au/statutorydocuments/generalpostalservices/frame.htm);

"GST" has the same meaning as defined in section 195 of the A New Tax System (Goods and Services Tax) Act 1999;

"Pack and Track International" means the Australia Post Pack and Track International delivery service as described at http://auspost.com.au/parcels-mail/pack-and-track-international.html, and governed by the Australia Post Terms and Conditions which apply to this service unless modified by the express provisions of this Agreement;

"Parcel Post" means the Australia Post Parcel Post delivery service as described in the Australia Post Terms and Conditions, and as modified by the express provisions of this agreement including the option of tracking or tracking with signature being available but only in conjunction with the Click and Send Service. Total scan events captured for the tracking or tracking with signature options may vary, particularly in remote locations.

"Postage Label" means a label either designating the value, and payment, of postage for a Postal Article consigned for delivery through the Service, or the shipping label indicating the Delivery Method and the designated delivery address whether printed by the Customer or otherwise;

"Postal Article" means an article of a kind that, under the terms and conditions on which Australia Post supplies postal services, may be carried by post;

"Registered Post International Parcel" means the Australia Post Registered Post International Parcel delivery service as described in the Australia Post Terms and Conditions as modified by the express provisions of this Agreement;

2. Relationship of these Terms to Australia Post and Service Specific Terms & Conditions Click to expand Click to collapse

2.1 This Agreement is supplementary to the Australia Post Terms & Conditions which are published at auspost.com.au/terms-conditions.html. To the extent that any aspect of the Click and Send service, or any separate Australia Post service provided through the Click and Send service, is not expressly referred to or included herein, the Australia Post Terms and Conditions apply. In the event of any inconsistency between the Australia Post Terms & Conditions, and these Click and Send Terms & Conditions, the Australia Post Terms & Conditions will prevail for the purpose of resolving the inconsistency.

2.2 Except to the extent (if any) expressly provided for in this Agreement, the conditions applying to the postal delivery services ordered by a Customer through Click and Send shall be the relevant service-specific terms and conditions made pursuant to the Australian Postal Corporation Act 1989, the regulations to the Act, the Australia Post Terms & Conditions, and other written instructions published by Australia Post from time to time.

3. Specific Service Conditions Click to expand Click to collapse

The Customer acknowledges that the following conditions apply to the Customer's use of the Click and Send Service:

(a) Australia Post cannot provide the Service if the Customer's computer system is not compatible with the Click and Send application. Australia Post accepts no liability for the consequences of the Click and Send Service not being capable of being supplied for any technical reason.

(b) The Customer must comply with all Click and Send instructions and procedures, and must supply full and accurate information whenever requested to do so in the course of the Customer applying for, and using, the Click and Send service. Without limitation, the Customer must supply accurate information concerning such matters as the Customer's personal information, (including pick-up address and pick-up instructions) the addressee of the article, and article size, weight, contents and value.

(c) The Customer must not, at any time, seek to use either the Click and Send Service, or any Australia Post delivery service, for the consignment of any Dangerous or Prohibited Goods. It is the Customer's sole responsibility to assess whether items for consignment are, or may be, classified as Dangerous or Prohibited Goods, and / or are items which are prohibited or regulated goods for the purposes of the laws of the country of destination. Australia Post provides information concerning Dangerous and Prohibited goods, [see for example - Dangerous & Prohibited items page and the Dangerous and prohibited goods packaging post guide (3.08mb)] but Australia Post does not represent that the information supplied is complete or up to date, and Australia Post has no liability for any consequence of a Customer sending, or attempting to send, any Dangerous or Prohibited goods by mail. The Customer's indemnity in favour of Australia Post (see clause 9.3) applies in the event that any loss, harm or damage arises out of the consignment of Dangerous or Prohibited Goods.

(d) Each Click and Send Postage Label is for a single use. Any attempt to copy, duplicate or re-use a Postage Label with the intention of securing the provision of a postal service without due payment constitutes a breach of these terms, and may constitute an offence under the Australian Commonwealth Criminal Code and the applicable postage charges will apply.

(e) The Customer accepts sole responsibility for assessing and advising accurate actual weights and dimensions of Postal Articles sought to be consigned through the Click and Send service. If any Postal Article consigned through Click and Send (whether consigned on the basis of an estimated weight calculated through the Click and Send weight estimator function or otherwise) is found by Australia Post to have an actual weight or dimension in excess of the weight or dimension stated by the Customer, acceptance and delivery of the Postal Article is at the sole discretion of Australia Post. If, in the exercise of its discretion, Australia Post chooses to accept, carry and deliver the Postal Article, such carriage and delivery is at the rate or cost applicable to the higher actual weight or dimension of the Postal Article, and the Customer authorises Australia Post to charge any additional costs of carriage and delivery by the same methodology as originally authorised by the Customer (see clause 8.2 (b) below).

(f) The Customer accepts sole responsibility for advising accurate pick-up and delivery instructions to Australia Post through the Click and Send website. Australia Post will not be responsible for any failure of, or delay in, the collection and / or delivery of any Postal Article if the Customer's instructions are ambiguous, incomplete, inaccurate, or are not followed by the Customer.

(g) Extra Cover may be requested at additional cost for some consignments of Postal Articles (but not for articles lodged for carriage by the International Registered Parcel Post Service). Specific terms and conditions (including exclusions) apply to Extra Cover. (h) The Customer is solely responsible for maintaining secrecy and security of any username and password which allows Customer's access to the Click and Send website. The Customer accepts responsibility for all transactions processed through the website after access is allowed following acceptance of the Customer's password.

(i) The Customer acknowledges the Postal Articles consigned to overseas addresses are subject to the laws - including the import and customs laws - of the destination country. The Customer must accurately supply all information requested by Australia Post in order that customs requirements may be met. A failure to supply accurate information may result in the delay, return or destruction of a Postal Article.

(j) Under the contract which will be made between Australia Post and the Customer on acceptance of these terms and conditions, Australia Post may (but is under no obligation to) make special or preferential offers available to Click and Send customers from time to time. If any such offers are made available they will be (a) subject to these terms and conditions, (b) be personal to the Customer (and strictly not for transfer or re-sale to any other person or entity) and (c) offered pursuant to any offer-specific terms which may be published or advised by Australia Post from time to time.

(k) The Customer must properly and adequately package each Postal Article for consignment by or through Australia Post. There are Australia Post flat rate boxes and satchels available for purchase online, or the Customer can select their own packaging. Australia Post reserves the right to decline to accept or carry any article which is in Australia Post's opinion inadequately or inappropriately packaged. Customers should use postal-specific product packaging of matching size category where flat rate postage has been selected, and have regard to Australia Post's packaging guidelines at auspost.com.au/internationalpost/information/packaging/.

(l) The Click and Send Service is personal to the Customer, and any purchase of Postage Labels through Click and Send for sale or re-supply to any person or entity other than the Customer is prohibited without the express written permission of Australia Post

(m) Customer's personal attendance at the time of courier collection of Postal Articles will be required when Australia Post is obliged to physically examine sender identification for certain services or Postal Articles.

4. Collection of Postal Articles Click to expand Click to collapse

4.1 Courier Pick-Up Exclusions - Courier Pick-Up of Postal Articles is not available to all addresses and locations. The Click and Send website will inform you if pick-up is not available at your address.

4.2 Collection - Where collection of a Postal Article is available through Click and Send, the Customer may choose a pick-up option from the Click and Send website. Australia Post will use its best efforts to meet the selected option but has no liability for any failure to do so for any reason (see also clause 9.1). The Customer shall provide detailed pick-up instructions to Australia Post when prompted by the Click and Send Service website instructions to do so. Courier pick-up involves an additional charge which varies depending on the service level selected.

5. Delivery Services Click to expand Click to collapse

5.1 The Customer acknowledges that the sole delivery services offered for Postal Articles consigned for delivery through the Click and Send service are the Australia Post:

(a) Express Courier International service
(b) Express Post International - Parcel service
(c) Registered Post International - Parcel service
(d) Air Mail service
(e) Parcel Post
(f) Express Post - Parcel service
(g) Courier Post
(h) Pack and Track International.

The service specific terms and conditions for these services are published by Australia Post at auspost.com.au.

5.2 The customer acknowledges that certain delivery choice options (Delivery Choice) and additional features are available at extra cost for the following products:

(a) Parcel Post, Express Post, Airmail, Express Courier International, Pack and Track International, Express Post International, Registered Post International

Delivery Choice options include:

(a) Customer Collect - the parcel is to be collected from a Post Collection Point
(b) Day Specific Delivery - delivery to an address on a specific day(s) of the week (Monday - Friday)
(c) Date Specific Delivery - delivery to an address on a specific date; and
(d) Date embargo - delivery to occur after a specific date.

Delivery Choice options are not available to all addresses and locations. The Click and Send website will inform you if Delivery Choice is available (also reference the Aus Post website http://auspost.com.au/parcels-mail/delivery-choices.html) and if so, at what cost. Australia Post will use its best efforts to meet the selected option but will have no liability for failure to do so for any reason (see also clause 9.1).

5.3 The Customer acknowledges that any delivery timetable and/or calculators relating to the services specified at clause 5.1 and 5.2 which may be published (including on the Australia Post website) provide Australia Post's best estimates only of the delivery time for postage services, and that those services are not guaranteed except to the extent (if any) specified in the service specific terms and conditions for a particular service.

6. Customer Warranties and Acknowledgements Click to expand Click to collapse

6.1 The Customer warrants that any and all data and information provided by the Customer to Australia Post is, and will be, complete, up to date, true and correct, to the best of the Customer's knowledge and belief, and that the Customer's use of both the Click and Send service, and any postal delivery service ordered through Click and Send, will be effected in full compliance with all of Australia Post's directions and requirements, and will comply with all laws, regulations and directions of Government or Governmental authorities whether in Australia or in the country to which the Customer's Postal Article is consigned.

6.2 The Customer agrees to pay to Australia Post, free of any deduction or set-off, any and all charges for services chargeable under the Click and Send Service and / or for the carriage of Postal Articles by or through Australia Post.

6.3 The Customer acknowledges that the lodgement of the Postal Article must be made at the closest lodgement point to the declared sender address.

6.4 The customer acknowledges that Australia Post may, in its sole and absolute discretion, refuse to accept data, information requests or instructions submitted through Click and Send where, in Australia Post's opinion, it is

(a) illegible, incorrect, or ambiguous, or (b) where payment is requested against an Australia Post Business Credit Account, and the account is inactive or overdrawn, or (c) the Customer is otherwise in material breach of any of the terms and conditions applicable to that Australia Post Business Charge Account, or (d) where Australia Post has grounds for believing that the Customer's use of the Service, or request for supply of a postal delivery service is, or could be, unlawful either in Australia or in another country through which the Customer's Postal Article may transit, or to which the Customer's Postal Article may be consigned.

6.5 The customer acknowledges that if they select a Delivery Choices option, these additional obligations will apply;

(a) You will be asked to provide your recipients' email addresses to Australia Post. By doing so, you warrant to Australia Post that you have obtained any necessary consent from your recipients and are otherwise acting in accordance with all applicable privacy legislation (see also clause 6.1);
(b) You agree articles must be lodged and manifested on the same day;
(c) You warrant to Australia Post that the delivery choice instructions given to Australia Post accurately reflect the options selected by your recipients (see also clause 3.1(f) and 6.1); and
(d) You acknowledge that if your Postal Article is lodged after the applicable facility lodgement close-off time, Australia Post may not be able to meet your chosen Delivery Choice option. Facility lodgement close-off times may vary according to location.

7. Intellectual Property Click to expand Click to collapse

7.1 All Intellectual Property rights of any kind, whether registered or unregistered, in the Click and Send service, is the sole property of, and/or vests in Australia Post. A person cannot reproduce or authorise the reproduction of any component of the Click and Send service text or images without Australia Post's prior written approval.

8. Payment Click to expand Click to collapse

8.1 The Customer shall pay the service charges specified by Australia Post (either on the Click and Send website or otherwise) using an approved online payment channel.

8.2 The Customer's application to use the Click and Send Service constitutes an authorisation by the Customer to Australia Post:

(a) to debit the Customer's Australia Post Business Credit Account, or nominated credit card (using PayPal, SecurePay or other methods that may be available from time to time), with the value of postage and other charges applied pursuant to the Click and Send service (certain exclusions apply); or
(b) to debit the Customer's Australia Post Business Credit Account, or nominated credit card (using PayPal, SecurePay or other methods that may be available from time to time), with the value of any additional charges for postage which are applicable due to the actual weight and / or dimension of the Postal Article being greater than represented by the Customer (see clause 3.(e) above).

8.3 Charges may be varied at any time at Australia Post's discretion. Charges are GST inclusive where GST is applicable. Courier pick up involves an additional charge which varies depending on the service level selected.

8.4 For the avoidance of doubt, for courier pickups of shipments containing both domestic and international items GST will be applicable for part of the pickup fee, based on the amount of domestic items compared with the total shipment.

9. Australia Post and Customer Liabilities Click to expand Click to collapse

9.1 Subject only to the Australia Post Terms and Conditions, (which include the terms and conditions of Extra Cover, and service specific terms and conditions for postal delivery services provided through Click and Send, which may in certain circumstances provide some remedy to a Customer for delayed delivery or non-delivery of Postal Articles) Australia Post shall not be liable to the Customer or to any other person (whether in contract, tort or otherwise) for any loss or damage suffered, or that may be suffered, as a result of any act or omission, whether negligent or otherwise, by or on behalf of Australia Post in relation to the promotion, provision, suspension or termination of the Click and Send service, or any other matter or thing relating to this Agreement.

9.2 To the maximum extent permitted by law, Australia Post expressly disclaims all conditions and warranties, express or implied, in respect of the Click and Send service and the carriage of any Postal Article pursuant to this Agreement. Where the law precludes such exclusion and implies certain conditions and warranties into this Agreement, the liability of Australia Post for breach of such condition or warranty shall be limited, at the option of Australia Post, to any one or more of the following:
9.2.1. supplying the Click and Send service again; or
9.2.2. payment of the cost of having the Click and Send service supplied again.

9.3 The Customer shall be liable to, and shall wholly indemnify, Australia Post for or against any loss claim or damage whatsoever which Australia Post may suffer or incur as a result of any action, proceeding, claim, demand or prosecution arising from this Agreement, the provision of the Click and Send service to the Customer, the carriage of any Postal Article lodged by the Customer through the Click and Send service, or any other matter or thing arising as a result of this Agreement, and which arises out of the Customer's conduct, negligence, breach of Agreement, mis-statement of fact (intentional or otherwise) or which in any manner or form arises out of either the nature condition or characteristics of premises of the Customer which are visited by Australia Post personnel, or the nature, condition, packaging, legality, or consignment of Postal Articles consigned to Australia Post. The liabilities imposed by this sub-clause continue and survive notwithstanding any termination of this Agreement.

9.4 Australia Post shall not be in default under the terms of this Agreement nor liable for failure to observe or perform in accordance with any provision of this Agreement for any reason or cause which could not with reasonable diligence be controlled or prevented by it, including without limitation, war, insurrection, riot, civil commotion, strikes, lock-outs, labour or industrial disputes, acts of God, acts of Governments or flood, storm, tempest, power shortages or power failure, system outages or interruptions, inability to obtain sufficient labour, raw materials, fuel or utilities. During the period of an incident or incidents of "Force Majeure" this Agreement shall be suspended.

9.5 All the rights, immunities and limitations of liability in this Agreement shall continue to have their full force and effect in all circumstances notwithstanding any breach of contract or of any conditions hereof by Australia Post.

10. Termination Click to expand Click to collapse

10.1 Australia Post may at any time, without cause, in Australia Post's sole and absolute discretion, suspend either the Customer's use of the Click and Send service, or the Click and Send service in its entirety. Unless Australia Post has an entitlement to suspend or cancel commenced Click and Send transactions (such as under these terms and conditions, or under the Australian Postal Corporation Act, or the Australia Post Service Terms and Conditions made under that Act) all Click and Send transactions commenced before any account suspension or termination will be completed.

10.2 The Customer may, at any time, without cause, suspend or terminate the Customer's participation in the Click and Send service, save that any incomplete Service or delivery instructions or payment liabilities which exist at the time of any such termination must be completed and effected in full irrespective of any such termination.

11. Governing Law Click to expand Click to collapse

This Agreement is governed by, and shall be construed in accordance with the laws in force in the State of Victoria, Australia, and the courts and registries of courts in that State shall have jurisdiction in the event of a dispute.

12. Privacy Click to expand Click to collapse

Australia Post respects the privacy of its Customers and their personal information. Any and all data and information collected by Australia Post through the provision of the Service will be managed strictly in accordance with the Australia Post Privacy Policy (at auspost.com.au/privacy-policy.html)

13. Trademarks & Copyright Click to expand Click to collapse

"Australia Post", "Parcel Post", "Express Post", "Express Post International", "Express Courier International", "Courier Post", "Registered Post International" and "Pack and Track International", are trademarks of The Australian Postal Corporation. No licence to use any of these trademarks is given or implied. The trademarks may not be copied, downloaded, reproduced, used, modified or distributed in any way (except as an integral part of an authorised copy of material appearing in these web pages) without the prior written permission of Australia Post. The contents of the Click and Send, and Australia Post "auspost" websites are in their entirety copyright to Australia Post and no reproduction or use of any of the text or images displayed on that site is permitted except in the limited circumstances permitted by law.

14. Sub-Contractors Click to expand Click to collapse

Australia Post reserves the right to authorise performance of any Australia Post obligations (either in respect of the Click and Send service, or any delivery or other function required to be completed by Australia Post) through contractors or sub-contractors to, or of, Australia Post. Where contractors and / or sub-contractors are engaged by Australia Post the same are included within the definition of "Australia Post" and are entitled to all of the benefits and rights imposed upon and enjoyed by Australia Post by these terms and conditions, or by any relevant provisions of the Australian Postal Corporation Act, the Australia Post Service Terms and Conditions, or the service-specific terms and conditions for any service ordered or supplied through Click and Send.

15. Variation Click to expand Click to collapse

Australia Post may vary these terms and conditions at any time by giving appropriate notice of proposed changes through the Click and Send website. Any use of the Service by a customer after any variation to the terms and conditions becomes effective will be deemed to constitute acceptance of the variations thereto, and any service supplied will be supplied on the terms and conditions as varied. If the Customer does not accept any variation to the terms and conditions, the Customer should terminate the Customer's participation in the Service as contemplated by clause 10.2 above.
